1. Acceptance and Modification of Terms
These Terms of Service ("Agreement") constitute a legally binding contract between you ("User", "you", or "your") and Monzed Labs OÜ, a company registered in Estonia with registration number 17338720 and registered address at Ahtri tn 12, Kesklinna linnaosa, Tallinn, Harju maakond, 15551, Estonia ("Company", "we", "us", or "our") governing your access to and use of the Clawder.eu and associated services (collectively, the "Services"). By accessing, registering for, or utilizing the Services, you expressly acknowledge that you have read, understood, and agree to be bound by this Agreement. We reserve the right to modify this Agreement at our sole discretion; continued use of the Services following any such modification constitutes your acceptance of the revised terms.
2. Provision of Services and Usage Mechanics
The Services provide access to proprietary artificial intelligence agents and secure cloud computing environments. Usage of the Services is metered via a proprietary credit system ("Credits").
- Credits act as a measurement of computational resource allocation and API utilization. The valuation and consumption rate of Credits are determined by the Company based on computational complexity and are subject to adjustment as detailed within your account dashboard.
- Credits are irrevocably deducted from your account balance in real-time as automated tasks and computational workloads are executed.
- Unused purchased Credits roll over to subsequent billing periods, strictly contingent upon the maintenance of an active, paid subscription tier. Promotional or complimentary Credits provided under a free tier do not accrue or roll over.
3. Acceptable Use and Restrictions
You are granted a limited, non-exclusive, non-transferable, and revocable license to access the Services. You expressly agree not to utilize the Services to:
- Facilitate, execute, or generate malicious code, ransomware, or engage in unauthorized penetration testing, denial-of-service (DoS) attacks, or network circumvention.
- Process, distribute, or generate unlawful, defamatory, infringing, or highly explicit material.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, underlying algorithms, or infrastructure topography of the Services.
- Circumvent or manipulate the Credit metering systems or API rate limitations.
The Company reserves the unilateral right to suspend or terminate your access immediately, without prior notice or refund, upon suspicion of a violation of these restrictions.
4. Ephemeral Workloads and Data Persistence
Computational workloads, including code generation and execution, occur within strictly isolated, ephemeral cloud environments. These environments are volatile by design. You acknowledge and agree that the Company assumes no liability for the persistence, integrity, or retention of data residing within these temporary instances. It is your sole responsibility to implement appropriate data redundancy protocols and commit mission-critical code to external, persistent repositories.
5. Disclaimer of Warranties and Limitation of Liability
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
